Federal Government undertaking review of Australian Sports Commission Act 1989
The Federal Government is undertaking a review of the Australian Sports Commission Act 1989 (ASC Act) as part of the Government's strategic approach to the 'Green and Gold Decade', culminating in the 2032 Olympic and Paralympic Games in Brisbane.
Public consultation is currently open until 28th June 2024. All interested stakeholders are invited to provide feedback on the ASC Act.
The Australian Sports Commission Act 1989 has not been substantially reviewed since it was established over thirty years ago. The sporting landscape has continued to evolve over this time, particularly in relation to threats to the integrity of sport and the significant growth in size and value of the sport sector.
Other developments in relation to sports integrity include the establishment of Sport Integrity Australia and the National Sports Tribunal in 2020. In addition, the Government plays an active role across multiple portfolios supporting the hosting of major international sporting events which provide social, sporting, and economic benefits for Australia.
The aim of the review is to ensure the legislation:
is fit for purpose
meets contemporary standards
positions the Australian Sports Commission (ASC) to deliver its objectives
enables the ASC to meet current and future needs in the Australian sport system.
Independent legal expert, Professor John McMillan AO, is leading the review, with support from law firm, Clayton Utz.
Professor McMillan will provide a report to government in late 2024 with recommendations on potential amendments to the ASC Act.
